Va. police arrest illegal immigrant in fatal crash; ICE struggles to track drunken drivers

FORT BELVOIR, Va. — This week's arrest of an illegal immigrant charged in a fatal crash in Fairfax County is again focusing attention on federal efforts to detain aliens accused of drunken driving.

Police charged Carlos Sanchez-Ramos, 33, of Springfield with aggravated involuntary manslaughter, driving while intoxicated and other counts.

Authorities say he lost control of his car on Richmond Highway on Monday, striking a Ford Fusion and pushing it into oncoming traffic. The Fusion was struck head on, killing 54-year-old Paul Krause of Fairfax Station. Police say Sanchez-Ramos fled the scene with a 3-year-old boy. He was arrested a short distance away.

Sanchez-Ramos entered the country illegally and was deported to Honduras in 2004, but returned to the U.S. between his deportation and 2007, according to immigration authorities...[Full Article]

‘Sanctuary policy’ set illegal alien free, now charged with child rape

On February 16, 2010, police in Prince William County, Virginia, filed charges against Marcos Banegas , 26, for forcible sodomy and aggravated sexual battery on an 8-year-old girl. The Honduran national has been on the run ever since, and remains at large.

It was a crime that could have been prevented if police in Montgomery County, Maryland, would have reported him to Immigration and Customs Enforcement when they had Banegas in custody. A year before he was charged with raping the girl in Virginia, he was arrested for second-degree assault on a child in Maryland.

However, because Montgomery County had an official policy against the police notifying ICE of a suspect’s illegal immigration status, Banegas was simply released after the charges were dropped by the girl’s mother, who was apparently dating Banegas...

Illegal immigrant sex offenders arrested in Va, DC

RICHMOND, Va. - State and federal officials this week arrested 15 illegal immigrants who have been convicted of sexual offenses in Virginia and Washington, D.C., and identified another 365 already behind bars who will be deported once they serve their sentences, authorities said Friday.

The 15 illegal immigrants arrested, including several whose crimes were against children or teens, had been convicted of sex crimes but had not previously been targeted for deportation. Thirteen were arrested in Virginia, and two in the nation's capital.

"Sex offenders are simply a scourge and they deserve our full law enforcement attention," U.S. Immigration and Customs Enforcement Director John Morton told reporters at a news conference to announce the results of Operation SOAR, or Sexual Offender Alien Removal...

Illegal alien convicted of raping his foster mom in Virginia

On Wednesday, Arturo Lopez, 18, was convicted of abducting and raping his foster mother in Henrico County, last April.

The 55-year-old victim told the jury of her pain, and how she can longer trust anyone, ending her long service as a foster mother, saying: “I don't have it in me emotionally to move over for someone else.”

The jury recommended a 20-year sentence for the abduction and 10 years for the rape. Lopez will be sentenced in November.

On April 9, the woman called police to report that her foster son had just raped her at knife point. The victim was able to leave the house and call 911, after telling Lopez that she had to get to work.

Lopez had been living on the streets of Richmond for just three days, when he was placed in the foster home in 2009. He turned 18 just five days before the brutal assault.

The Mexican national told detectives he simply walked across the border and took a bus to Richmnond, Va.

Illegal Immigration: Someone Has to Step Up and Enforce the Law

The Times-Dispatch said that "setting immigration policy is a federal job. Washington needs to shoulder the responsibility it has abdicated." I agree. However, protecting the lives of citizens is the duty of every level of government. The federal government has failed to protect citizens from illegal aliens who commit crimes. The federal government's failure, however, is no excuse for states and localities to abdicate our duties as well. That is the principal that guides the Virginia rule of law campaign.

Prince William County's rule of law policy, the original version of which was introduced by Supervisor John Stirrup in June 2007, mandates that every individual under custodial arrest, regardless of race or ethnicity, be checked for immigration status. Those checks resulted in 3,000 illegal aliens being handed over to Immigration and Customs Enforcement (ICE) for deportation. But the real impact of Prince William's policy was not the immigration checks, but the message that it sent: If you are illegal, you would be wise to leave our community or, at least, stay out of trouble...

Arrest of third suspect in which illegal aliens repeatedly raped 6-year-old (w/video of arrest)

Police in Williamsburg, Va., have arrested a juvenile, whose name is being withheld due to his age for repeatedly raping a 6-year-old girl. His arrest comes after two others, Tito Guirao-Aguilar, 39, and Samuel Eli Jacobo-Guirao, 20, were apprehended for victimizing the girl.

Guirao-Aguilar has been charged with three counts of aggravated sexual battery of a person under the age of 13, and Jacobo-Guirao is charged with one count of rape of a person under the age of 13 and two counts of aggravated sexual battery of a person under 13.

Both men are being held in the Virginia Peninsula Regional Jail without bond. Immigration and Customs Enforcement has also placed a hold on them.

The most popular tourist destination in the state, Williamsburg has a growing crime problem attributable to its illegal alien population, who are largely employed by the hotel and restaurant industry.

On June 10, Williamsburg police arrested illegal alien Raul Vasquez-Garcia, 33, in front of the same apartment complex where he allegedly shot a man, a week earlier.

On the night of June 4, police arrived at the Village of Woodshire apartments on Merrimac Trail, they found a man suffering from two gunshot wounds. According to police, the man and Vasquez-Garcia had been arguing over a woman.

The victim was taken to a local hospital, where he recovered from his wounds and has since been released.

Vasquez-Garcia is charged with attempted murder, use of a firearm in the commission of a felony and assault.

ACLU: Ignore Cuccinelli on immigration inquiries

The ACLU of Virginia yesterday urged law enforcement agencies to ignore Attorney General Ken Cuccinelli's opinion on their power to inquire about immigration status, while opponents of illegal immigration pushed for more severe action.

Del. Robert G. Marshall, R-Prince William, who sought the opinion that Cuccinelli issued last Friday, sent a letter yesterday to all Virginia sheriff's offices to encourage them "to do all that you can" using the powers described in the opinion to root out gangs...

Drunk illegal alien, awaiting deportation kills nun in Va.

On Sunday, Prince William County police arrested Carlos A. Martinelly Montano, 23, after he slammed head on into a car in which three Benedictine nuns were traveling. Sister Denise Mosier was killed instantly, her two companions were taken by helicopter to the hospital where they both remain in critical condition.

Montano was charged with DUI and involuntary manslaughter.

This is actually Montano’s third DUI arrest in Prince William County over the last five years. At the time of the crash, the illegal alien was free on bond while awaiting deportation proceedings.

Montano is currently being held without bond at the Prince William-Manassas regional jail.

A list of a of few Montano’s offenses follows:

- April 2009…he was arrested for driving without a license and convicted in June.

-October 2008…he was stopped for driving 55 in a 35 mph zone, and was found to have a .17 blood alcohol level. Montano was sentenced to three years probation and his driver’s license was suspended.

-December 2007…he was arrested for being drunk in public.

-July 2007…he was charged with DUI and convicted later that same year...

30 alleged gang members arrested in No.Va.

A sweep targeting violent foreign gangs in Northern Virginia has netted 30 gang members and associates, most of whom are believed to be in the country illegally.

Most of the alleged gang members and associates in Northern Virginia were arrested on immigration violations, but Immigration and Customs Enforcement officials say some have criminal pasts and are associated with dangerous gangs, including MS-13, Mexican Pride and Southside Locos.

The sweep was conducted Wednesday through Friday and was part of an ongoing nationwide crackdown, ICE officials said...

Dad Fears Accused Killer Will Go Free

JAMES CITY COUNTY, Va. (WAVY) - The deaf, mute, illegal immigrant arrested five years ago for allegedly raping and murdering a 16-year-old girl could possibly be set free without ever standing trial.

Oswaldo Martinez, 36, from El Salvador, is not able to speak, hear, read or write. Prosecutors said Tuesday that if the state is not able to teach the accused killer sufficient sign language so that he can communicate with his attorneys and stand trial, it is possible the judge would be unable to figure out what to do with Martinez, except set him free.

Martinez was charged in February 2005 with Capital Murder. Police said his DNA matched evidence from the crime scene where Brittany Binger's body was found the month before, at the grassy entrance to Whispering Pines Mobile Home Park where she lived.

Immigration Agents Bust Norfolk Document Mill

Federal immigration agents said they have uncovered another document mill capable of producing hundreds of counterfeit identification papers for illegal immigrants.

This is at least the fourth such operation in recent months that U.S. Immigration and Customs Enforcement has busted locally.

After a two-month investigation, ICE agents on Sunday raided a Norfolk home and arrested Fernando Alvarado-Uribe. A second suspect, his cousin Melesio Munoz-Uribe, disappeared before agents arrived. The location of the raid was not disclosed...

Police In Norfolk, Va. Aiding And Abetting Illegal Aliens

On Saturday, the Norfolk Police Department will conduct a seminar instructing those working in this country illegally on steps they can take when they feel they have been treated unfairly by their employers.

Norfolk Police Officer Damaso Medel will be leading the event, which will be held at the city’s Police Training Center.

Legal Aid of Eastern Virginia, various government welfare agencies, and illegal alien advocacy groups will be in attendance.

In the past year, Immigration and Customs Enforcement agents have uncovered two separate document mills in Norfolk, which produced thousands of fake Social Security cards, as well as other forms of identification for illegal aliens.

Despite pleas from the public, Norfolk officials continue to ignore the issue of illegal immigration, even in the face of increasing crime attributed to the city’s growing illegal alien population...
